หนังสือสัญญาเช่าบ้าน ฉบับที่……….

สัญญาทำที่… บ้านเลขที่ 135 ถนนสวนสน อำเภอเมือง จังหวัดประจวบคีรีขันธ์
วันที่…20..เดือน มกราคม….พ.ศ…2557.. ระหว่าง…นาง ชาลิสา ทับเนียม..ซึ่งต่อไปนี้เรียกว่าผู้ให้เช่า ฝ่ายหนึ่ง กับนาง รัตนา ถาวร ซึ่งต่อไปนี้รียกว่า ผู้เช่าอีกฝ่ายหนึ่ง ได้ทำสัญญากันดังต่อไปนี้
ข้อ 1. ผู้ให้ผู้เช่าตกลงให้เช่าและผู้เช่าตกลงรับเช่า…บ้านเลขที่ 135 ถนนสวนสน อำเภอเมือง
จังหวัดประจวบคีรีขันธ์ เพื่อค้าขาย มีกำหนดเวลา….4…..ปี นับตั้งแต่วันที่ 20 มกราคม 2557
และหมดอายุสัญญา วันที่ 20 มกราคม 2560 โดยผู้เช่ายอมเสียค่าเช่าให้แก่ผู้ให้เช่า เป็นเงินค่าเช่ารายปี ปีละ 84,000 บาท (แปดหมื่นสี่พันบาทถ้วน) ทั้งนี้ผู้เช่าลดค่าเช่าให้ 2 ปีแรก เหลือปีละ 7,5000 บาท โดยผู้เช่าตกลงจ่ายเป็นระยะเวลา 2 ปี รวมเป็นจำนวนเงิน 150,000 บาท โดยปีที่ 3 - 4 จะจ่ายตามสัญญาข้างต้น
ข้อ 2. ผู้ให้เช่าได้รับเงินล่วงหน้าไว้เป็นประกันการเช่าจากผู้เช่าเป็นจำนวนเงิน..….-…...บาท
ข้อ 3. ผู้เช่ายอมชำระค่าเช่าแก่ผู้ให้เช่า ภายในวันที่ 20 มกราคม 2559 และ 20 มกราคม 2560ของทุกปี ถ้าไม่ชำระตามกำหนดนี้ผู้เช่ายอมให้ผู้ให้เช่ายึดทรัพย์สินของผู้เช่าได้ และใส่กุญแจห้องของผู้เช่า ก็ได้
ข้อ 4. ค่าภาษีโรงเรือนและที่ดินผู้เช่าจะเป็นคนรับภาระค่าใช้จ่ายทั้งหมดเอง
ข้อ 5. ผู้เช่ายอมรับรักษาตัวบ้านที่เช่ามิให้ชำรุดทรุดโทรมไปกว่าเดิม ถ้าผู้เช่ามีความประสงค์จะดัดแปลงหรือเพิ่มเติมสิ่งใดลงไปอีก ต้องได้รับอนุญาตจากผู้ให้เช่าเป็นลายลักษณ์อักษรก่อนจึงจะทำได้ ถ้าเกิดการเสียหายใด ๆ ขึ้นผู้เช่ายอมรับผิดใช้ค่าเสียหายทั้งสิ้น
ข้อ 6. บรรดาสิ่งก่อสร้างหรือซ่อมแซมลงในบริเวณบ้านเช่านี้ เมื่อผู้เช่าออกจากบ้านเช่า ห้ามมิให้รื้อถอนหรือทำลายเป็นอันขาด และสิ่งก่อสร้างซ่อมแซมดังกล่าวแล้วนั้นต้องตกเป็นของผู้ให้เช่าทั้งสิ้น โดยผู้เช่าจะเรียกค่าเสียหายใด ๆ ไม่ได้เลย ถ้าเกิดอัคคีภัยขึ้น สัญญานี้เป็นอันระงับสิ้นสุดลง
ข้อ 7. ผู้เช่ารับว่าจะไม่ให้ผู้อื่นเช่าช่วงต่อไปอีกทอดหนึ่ง เว้นแต่จะได้รับอนุญาตจากผู้ให้เช่าเป็นลายลักษณ์อักษร และจะไม่ยอมให้ผู้หนึ่งผู้ใดอยู่อาศัยดำเนินกิจการค้าขายหรือรับใช้ในหน้าที่ใด ๆ ภายในสถานที่เช่านี้ เว้นแต่จะได้รับอนุญาตจากผู้ให้เช่าเป็นลายลักษณ์อักษร และผู้เช่ายอมให้ผู้ให้เช่า หรือตัวแทนของให้ผู้เช่าเข้าตรวจดูบ้านเช่าได้เสมอ ถ้าผู้เช่าออกไปจากบ้านไม่ว่ากรณีใดผู้เช่าจะเรียกค่าเสียหายหรือค่าขนย้ายจากผู้ให้เช่าไม่ได้
ข้อ 8. ผู้เช่าต้องจัดการในบริเวณบ้านเช่าอย่าให้มีสิ่งโสโครกและมีกลิ่นเหม็น และไม่กระทำการอึกทึกจนคนอื่นได้รับความรำคาญปราศจากความปกติสุข และไม่เก็บรักษาสิ่งที่เป็นเชื้อเพลิง และไม่กระทำสิ่งใด ๆ ที่น่าหวาดเสียวหน้าจะเป็นอันตรายแก่ผู้อยู่ใกล้เคียง
ข้อ 9. ถ้าผู้เช่าจะประกันเพลิงไหม้สำหรับทรัพย์สมบัติหรือสินค้าของตนภายในบริเวณบ้านเช่าต้องได้รับอนุญาตจากผู้ให้เช่าเป็นลายลักษณ์อักษรก่อนจึงจะประกันเพลิงไหม้ได้

ข้อ 10. ถ้าผู้เช่าจะประพฤติผิดล่วงละเมิดสัญญาแม้แต่ข้อหนึ่งข้อใด หรือกระทำผิดวัตถุประสงค์ข้อหนึ่งข้อใด ยอมให้ผู้ให้เช่าทรงไว้ซึ่งสิทธิที่จะเข้ายึดครอบครองสถานที่และสิ่งที่เช่าได้ โดยพลันและมีสิทธิบอกเลิกสัญญาทันที
ข้อ 11. เมื่อครบกำหนดสัญญาเช่าก็ดี หรือผู้เช่าผิดสัญญาเช่าก็ดี ผู้เช่ายอมให้ถือว่าผู้เช่ายอมออกจากที่เช่า
ข้อ 12. ถ้าผู้ให้เช่าตกลงขายทรัพย์สินที่เช่าให้แก่ผู้ใดก่อนครบกำหนดการเช่าตามสัญญานี้ ผู้ให้เช่าจะแจ้งให้ผู้เช่าทราบล่วงหน้าเพื่อผู้เช่าเตรียมตัวออกจากทรัพย์สินที่เช่าเป็นเวลาไม่น้อยกว่าสองเดือน และผู้ให้เช่าจะต้องแจ้งให้ผู้เช่าทราบด้วยว่าจะตกลงขายแก่ผู้ใดเป็นเงินเท่าใดเพื่อผู้เช่าจะได้มีโอกาสตกลงซื้อได้ก่อนในเมื่อเห็นว่าสมควร
ข้อ 13. ทั้งสองฝ่ายมีความเข้าใจในข้อสัญญานี้โดยตลอดแล้ว จึงได้ลงลายมือไว้เป็นหลักฐาน
